1. Who you are buying from
Merchandise on ActsSocial is sold by Trinity Proximity, Inc. d/b/a ActsSocial, 6841 Virginia Parkway, Suite 103 Unit 435, McKinney, Texas 75071, United States. These Terms of Sale apply to every purchase. The Terms of Service, Privacy Policy and Cookie Policy also apply; where they differ from these Terms of Sale on a matter about a purchase, these Terms of Sale control.
2. Who can buy
You must be 18 or older. Buying does not require an ActsSocial account.
3. Placing an order
Your order is an offer to buy. We accept it when we send the order confirmation email. We may decline or cancel an order before shipment where an item is unavailable, a price or description was displayed in error, we cannot ship to your address, we suspect fraud, or the order breaches these Terms. If we cancel after payment, we refund in full within 10 business days.
4. Made to order
Most items are printed or made when you order them by our fulfillment partner, Printful, Inc., which ships them directly to you. Processing times are in the Shipping Policy. Made-to-order does not reduce your return rights under Section 8.
5. Prices, taxes and currency
Prices are shown in US dollars and exclude tax. The price you pay is the price shown at checkout. United States sales tax is added at checkout where we are required to collect it. We do not collect VAT, GST or any other tax for orders shipped outside the United States. For international orders, import duties, customs fees and local taxes are your responsibility and are payable to the carrier or your customs authority before or on delivery. They are not collected at checkout and we cannot predict them.
6. Payment
Payment is processed by Shopify. Your card details are entered into and processed on Shopify's systems and are not received or stored by ActsSocial. No card field is ever displayed on an ActsSocial page. We charge when the order is placed.
7. ActsSeeds gift card credit
If you apply ActsSeeds gift card credit, it is applied as a credit against the order total. Card credit has no cash value. Because the credit is a gift card rather than a discount code, sales tax where we are required to collect it is calculated on the price before your credit is applied. If you return an order paid partly with card credit, the card portion is returned to your card and the cash portion to your original payment method. 8. Returns, refunds and our guarantee
Our Returns and Refunds Policy at actssocial.com/shop/returns forms part of these Terms. In summary: you may return any item within 30 days of delivery for a full refund of the price paid, whatever the reason. Nothing in these Terms limits rights you have under the law where you live, including the fourteen-day cancellation right for consumers in the European Union and the United Kingdom, and the statutory guarantees of conformity that apply there.
9. Delivery and risk
Delivery terms are in the Shipping Policy at actssocial.com/shop/shipping, which forms part of these Terms. Risk of loss or damage passes to you when the goods are delivered to you or to a person you nominated. Until then it is ours. If an order is lost or arrives damaged, you deal with us, not the carrier.
10. Warranty
We warrant that items will be free from defects in materials and workmanship for 30 days from delivery. If an item is defective we will replace it or refund it at your choice. To the extent permitted by law, this is the only express warranty and we disclaim implied warranties including merchantability and fitness for a particular purpose. Consumers in the EU and UK have statutory rights in respect of goods that do not conform to the contract, and those rights are not affected by this Section.
11. Product information and product safety
We try to describe items accurately. Colours vary between screens and between print runs. Sizing charts are guides. If an item is materially different from its description, Section 8 applies. For buyers in the European Union, each product page carries the manufacturer's details, the details of our responsible person in the EU, and the materials and care information required by the General Product Safety Regulation.
12. Intellectual property
Designs, artwork and the ActsSocial name are ours or licensed to us. Buying an item does not licence you to reproduce a design.
13. California residents
Some products may expose you to chemicals known to the State of California to cause cancer, birth defects or other reproductive harm. Where a specific warning applies to an item, it appears on the product page. See www.P65Warnings.ca.gov.
14. Liability
Our liability for a purchase is limited to the price you paid for the item, except for liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, and for consumer rights that the law says cannot be excluded.
15. Disputes
Section 16 of the Terms of Service, including arbitration and the 30-day opt-out, and Section 17 on governing law and venue apply to purchases. If you are a consumer in the European Union, the United Kingdom or another country whose law gives you the right to bring a claim in your local courts under your local consumer law, nothing here takes that right away.
16. Changes
We may change these Terms of Sale. The version in force when you place an order applies to that order.
